A former Rutland City police sergeant who shot and wounded two men during a 2023 incident was sentenced to two years of probation in Vermont on Monday, according to the Vermont attorney general’s office.

The office said Andrew Plemmons, 47, pleaded guilty to one misdemeanor count of reckless endangerment, and the court imposed probation terms that included 100 hours of community service. The sentencing was set in Vermont Superior Court in Rutland.

If Plemmons follows the conditions of probation, the attorney general’s office said he would avoid prison time. The office also said that if he violates probation, he could face up to a year in prison.

Rutland City Police Sgt. Richard Caravaggio said Plemmons had been on paid administrative leave since the attorney general’s office initially charged him in October 2024. Caravaggio also said he could not comment on the specifics of Plemmons’ situation, but that administrative leave is typically fully paid.

Caravaggio said Plemmons resigned from the force last week, and his last day of employment was Saturday. He added that, although he did not know whether the department would pursue its own investigation into the 2023 incident, it is standard protocol for police departments to wait until criminal charges are resolved before beginning their own investigations.

The criminal case stemmed from a 2023 encounter in which Plemmons and another officer approached what they described as a “suspicious” vehicle and told two brothers they wanted to search it. Court documents previously reported by VTDigger said Plemmons fired into the vehicle after one brother tried to drive away, wounding him, and then fired again when the second brother took the wheel and continued driving.

The attorney general’s office chose to pursue charges, according to the report, after deciding that Plemmons’ use of force against the second brother “was not justified.” Plemmons’ attorney could not immediately be reached for comment on Monday.

The report also said court documents previously reported on by VTDigger indicate that Plemmons faced additional charges in 2024—aggravated assault with a deadly weapon and reckless endangerment—after the Massachusetts incident involving the brothers. It said he could have faced up to 16 years in prison if convicted on both charges.
