Tallahassee Memorial Hospital has dropped its lawsuit seeking to remove a woman from a hospital room months after she was discharged, the hospital said. In a statement Monday, spokesperson Sarah Cannon said the case is no longer active because the patient is no longer at Tallahassee Memorial Hospital.

The hospital previously asked the court for an injunction tied to the woman’s continued occupation of room 373. The filing sought an order requiring the woman to leave the room and asked that the county sheriff’s office be authorized to assist if necessary.

According to the hospital’s lawsuit, resources were being diverted from helping other patients because the room remained occupied. The hospital said the woman was admitted for medical treatment and that, once she no longer needed acute care services, it issued a formal discharge order on Oct. 6.

AP previously reported on March 19 that Tallahassee Memorial Hospital had sued in connection with the woman’s refusal to leave after discharge; MSI previously reported the hospital’s eviction lawsuit. In the new development, the hospital said the matter ended after the patient left the facility.

A hearing had been scheduled for Monday, but the hospital said it was canceled after the hospital filed a notice of voluntary dismissal with prejudice. Cannon said the notice was filed and that the case is not active because the patient “is no longer at TMH.”
