President Donald Trump announced Saturday that he intends to raise global tariffs to 15%, escalating his trade policy following a Supreme Court decision Friday that struck down his emergency-powers tariff authority in a 6-3 ruling. Trump said he would implement the new tariffs using an alternative legal authority through an executive order that bypasses Congress.

The Supreme Court ruled that the president lacked constitutional authority to unilaterally impose tariffs because the power to tax rests exclusively with Congress. Trump’s original announcement of a 10% tariff rate is set to take effect Tuesday, the same day as his State of the Union address.

The ruling represents a significant check on Trump’s authority, but the president’s determination to maintain tariffs as a policy tool suggests the court’s decision may prove a temporary impediment to his plans.

Trump made the announcement on social media Saturday morning, one day after the Supreme Court ruled that the president lacked constitutional authority to unilaterally impose tariffs because the power to tax rests exclusively with Congress.

“I am basing this on a thorough, detailed, and complete review of the ridiculous, poorly written, and extraordinarily anti-American decision on Tariffs issued yesterday,” Trump wrote on social media.

The new tariffs would take effect Tuesday, the same day as the president’s State of the Union address. The executive order Trump signed grants him authority to bypass Congress and impose the import taxes, though the tariffs are limited to 150 days unless Congress acts to extend them.

Trump’s Judicial Rebuke

Trump responded sharply to the justices who ruled against him. He made pointed personal attacks on two justices he appointed during his first term—Justices Neil Gorsuch and Amy Coney Barrett—saying the court’s decision was “an embarrassment to their families.”

Trump continued the criticism across social media, complaining about Gorsuch, Barrett, and Chief Justice John Roberts, who wrote the majority opinion. He singled out Justice Brett Kavanaugh, who dissented in a 63-page opinion, calling Kavanaugh his “new hero.” Trump also praised Justices Clarence Thomas and Samuel Alito, the two other justices in the minority.

“There is no doubt in anyone’s mind that they want to MAKE AMERICA GREAT AGAIN!” Trump wrote of the three dissenters.

Tariff Revenue and Policy

Tariffs have been central to Trump’s economic policy. He has said they address trade imbalances, revive U.S. manufacturing, and apply international pressure on other nations to act on various issues including drug trafficking and regional conflicts.

Federal data shows the Treasury collected more than $133 billion from the import taxes Trump imposed under the emergency powers law as of December. Trump has made repeated promises about the use of those funds, including paying down the national debt and distributing dividend checks to taxpayers. The Supreme Court’s ruling does not address what will become of the funds already collected.

Democratic Opposition

House Ways and Means Committee Democrats quickly criticized the renewed tariff announcement. “A little over 24 hours after his tariffs were ruled illegal, he’s doing anything he can to make sure he can still jack up your costs,” they wrote on social media.

California Gov. Gavin Newsom, a Trump critic, characterized the move more directly. “He does not care about you,” Newsom wrote on social media.
